PTI wants SC to declare Practice and Procedure Act ‘unconstitutional’

PTI submits response to SC

The Pakistan Tehreek-e-Insaf (PTI) submitted a response on Wednesday to the Supreme Court regarding the ongoing case challenging the Practice and Procedure Law.

In their submission, the PTI has requested the declaration of the Supreme Court (Practice and Procedure) Law 2023 as null and void.

The petition argues that the law is unconstitutional and specifically calls for the unconstitutional designation of clauses 2, 3, 4, 5, 7, and 8 of the Act.

The plea stated the Supreme Court (Practice and Procedure) Law infringes upon the independence of the judiciary. It asserts that the law interferes with the internal administration of the judiciary, undermining its autonomy.

In a recent development, Abid Zuberi, the President of the Supreme Court Bar Association, expressed his concerns about the law.

In a written response submitted to the Supreme Court, Zuberi stated that the Parliament has curtailed judicial authority by enacting the Supreme Court (Practice and Procedure) Bill 2023.

He further contended that the law contradicts constitutional principles.

Zuberi’s response emphasized that, according to Article 191, the Supreme Court holds exclusive power to amend the Rules.
